The Jack Bull - Part Two

The Minnesota Judicial Branch is out of control.

Nancy Lazaryan is a Jack Bull and is heading up a group of Minnesotans that are concerned over the way the judiciary (at all levels) abuses its authority, denying the citizenry of the protection of law they deserve. We think this effort to expose judicial injustice should be extolled - kudos to Nancy and company!

The Minnesota Judicial Branch is out of control.
The Minnesota and United States constitutions are compacts. A compact is a type of contract. The contract is between the People; it is amongst ourselves that we jointly agree how we live together in society. We, the People, are the principals in the contract.

"We, the people of the state of Minnesota, grateful to God for our civil and religious liberty, and desiring to perpetuate its blessings and secure the same to ourselves and our posterity, do ordain and establish this Constitution."

The government, and those that work for us in government, are our agents. The principals tell the agents what to do. The agents never have the authority to tell the principals what to do, because the agents are NOT a part of the contract. The people that work in government are charged with carrying out and administering the stipulations, regulations and functions of the contract between the principles - they are our employees, and we write the job descriptions for them.

To suggest that "we the people" are subordinated to the agents of our "compact", namely (in this case) the judiciary would be like the masters subordinating themselves to household full of dogs that decide to take over the household. The dogs might get away with it and in reality holds the power in the household over the people who live there, but that doesn't change the right relationship of the master to exercise authority over the dog. "We the people" are not the dog, we are the masters.

There is system of order that defines who has authority - "Natural Law". In a free society, were it is presumed that one man is equal to the next, and in our system of governing our civility where the authority is codified on the basis of God's supremacy over man, it is imperative that this basis in our law be held clearly in plain view among us. If you create something, then you have authority over what you created.

Here is the natural order of authority that follows from our Creator.

  1. God created Man...the Creator is over Man
  2. Man created Government...man is over government
  3. Government creates corporations...government (e.g. The courts) is over corporations
  4. Corporations create products and services, and have authority over products and services, and nothing else.

The People are the sovereigns and are not corporations created by the state; therefore we are the ONLY one that has the authority to create law and we have chosen to create our law through representatives that we elect to the Minnesota Legislature. We have authority over the law, because we create the law through the agency of the Legislature.

This brings us to our current objection - judges legislating from the bench. They are our agents to judge the law written by the legislature. We did NOT authorize our agents in the Minnesota Judicial branch to:

  • create our laws
  • change our laws
  • participate in the creation of our laws
  • unionize against us
  • decide who we elect as judges
  • determine whether our legislated laws are valid
  • discipline themselves
  • etc.

We NEVER gave the judges the authority to judge us as individuals; that is reserved for a jury of 12 other Citizens. Judges directly adjudicate over corporations, not people. That is basic to the difference between civil and criminal court.

The Minnesota Judicial branch is revolting against the People, their employers. They have taken control over our law. They have taken control over We the People. The judiciary has done this by writing "case law." Think about the master-pet analogy, and you should be able to see that this is like the dogs tearing into the cushions of the couch while you're away that serves to rob the power from the master when the master doesn't do anything to solve the problem . In this analogy we are the master and the judges are the dogs (fitting mental picture). Power without authority can ONLY lead to tyranny, and the pet dogs are grabbing the power over the master. By (We the People) not exercising the authority to discipline and properly train and restrain the dogs (the judges) we are actually breeding the injustice the dog forces on everyone in the household by their antics, and the master is responsible for it. Here's the irony of what has happened: this "case law" is a set of binding opinions that says you cannot sue a judge. The dogs are ruling the household!

As if the case law trick isn't bad enough, they have created a Union that conducts private, "public-not-welcome" seminars to predetermine how court cases will be determined; and they are using the judge's union to lobby our legislature to change laws and to get more money for the judges. Can you say POWER GRAB?!

Did you know that the judges have written rules that a person has to be an attorney if they are going to run in an election to be a judge? We the People never created that requirement; it isn't in the MN Constitution in any form.
