Ms Lazaryan:
We have reviewed your request for a meeting with the Adjutant General to
discuss remedies the people of Minnesota have relative to crimes you stated
were committed by state officials.
The Minnesota National Guard does not have the authority to take action
relative to your complaints against the members of the Minnesota Judiciary or
other state officials. Accordingly, the Adjutant General declines your
request for a meeting.
The Minnesota National Guard is the organized militia of the State of
Minnesota. As
the state militia, the Minnesota National Guard is subordinate
to civil power in the state and specifically to the Governor. As
Commander-in-Chief of the state military forces, the Governor is the sole
authority for calling out those forces ". . . to execute the laws,
suppress
insurrection and repel invasion." (See: MN Const Art. V, Sec. 3, See also:
MN
Stat. §190.02 and §191.05) As indicated in your message, the Governor has
already declined to take action in this matter. There is no authority under
Minnesota law for the Minnesota National Guard
to act without the direction
of the Governor to enforce the laws of Minnesota.
